Chemical weapons



(a) Elimination

Encourages Member States to assist the Government of National Accord in providing support, including personnel, technical expertise, information, equipment, and financial and other resources and assistance, in coordination with the Director-General of the OPCW, to enable the OPCW to implement the elimination of Libya’s category 2 chemical weapons safely and in the soonest practicable timescale;

Decides to authorize Member States to acquire, control, transport, transfer and destroy chemical weapons identified by the Director-General of the OPCW, consistent with the objective of the Chemical Weapons Convention, to ensure the elimination of Libya’s chemical weapons stockpile in the soonest and safest manner, with appropriate consultations with the Government of National Accord;

(b) Domestic control

Reminds Member States of their obligation under Resolution 1540 (2004) that all States shall take and enforce effective measures to establish domestic controls to prevent the proliferation of nuclear, chemical or biological weapons and their means of delivery, and reaffirms its decision that Member States shall inform the Security Council immediately of any violation of resolution 1540 including acquisition by non-State actors of chemical weapons, their means of delivery and related materials;

(c) Seizure and disposal following inspection

Decides to authorize all Member States to, and that all Member States shall, seize and dispose of items the supply, sale, transfer, or export of which is prohibited by paragraph 8 (a), 8 (b), or 8 (c) of resolution 1718 or by paragraph 9 or 10 of this resolution that are identified in inspections pursuant to paragraph 11, 12, or 13 in a manner that is not inconsistent with their obligations under applicable Security Council resolutions, including resolution 1540 (2004), as well as any obligations of parties to the NPT, the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction of 29 April 1997, and the Convention on the Prohibition of the Development, Production and Stockpiling of Bacteriological (Biological) and Toxin Weapons and on Their Destruction of 10 April 1972, and decides further that all States shall cooperate in such efforts;

The resolution recognized States' non-proliferation commitments and binding legal treaty obligations and decided that none of the obligations under the 1540 regime shall conflict with or alter the rights and obligations of State Parties to the Nuclear Non-Proliferation Treaty (NPT), the Chemical Weapons Convention (CWC) and the Biological and Toxin Weapons Convention (BWC) or alter the responsibilities of the International Atomic Energy Agency (IAEA) and the Organization for the Protection of Chemical Weapons (OPCW).
